Description

In Saxon-EE 9.7.0.8J, sort((1, <_>1</_>)) completes without errors. I am not 100% sure, but I would have expected the query to return XPTY0004 (similar to @1 lt <>1</>@).

Yes, this is very similar to the recently-added QT3 test case fn-sort-error-003 which we are currently failing. I only noticed that after creating this variant as fn-sort-error-004.

This is a duplicate of bug #3450. We decided not to fix it on the 9.8 branch because of the risk that it would break working applications; it will be fixed in the next major release instead.
