Description
XSLT3.0 element documentation such as for xsl:mode
describe "Available in XSLT 3.0. Available in all Saxon editions. Implemented since Saxon 9.6." Unfortunately that is not the case - the HE version does not support such elements at least until the standard is finalised. Likely to be similar for some 10+ other XLST instructions.
We have already seen some confusion regarding such feature support in HE

Documentation for all new XSLT 3.0 elements updated to give correct Saxon edition implementation information. Corrected in userdoc/saxon9/src and viewer_app/doc in 9.6 archive (and same for 9.7 development), and updated on the live website (XML and HTML versions).
